General Conditions of Sale – Le Secret Skincare
1. Preamble
These general conditions of sale apply to all sales concluded on the website LeSecret-skincare.com, owned by EcomSulting LLC.
EcomSulting LLC is a company incorporated in the State of Wyoming, United States, with its registered office at 1309 Coffeen Avenue STE 1200 Sheridan, Wyoming 82801.
The website LeSecret-skincare.com sells personalized cosmetic products, including Le Secret™ Serum.
The customer declares to have read and accepted the general conditions of sale prior to placing his order. Validation of the order therefore constitutes acceptance of the general conditions of sale.
2. Products
2.1. The products offered for sale are those which appear on the LeSecret-skincare.com website, within the limit of available stocks.
2.2. EcomSulting LLC reserves the right to change the product assortment at any time.
2.3. Each product is accompanied by a description established by EcomSulting LLC. The photographs are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors.
3. Price
3.1. The prices listed on the site are in Euros, all taxes included (TTC), taking into account the VAT applicable on the day of the order.
3.2. EcomSulting LLC reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
3.3. The prices indicated do not include order processing, transport and delivery costs, which are charged in addition, under the conditions indicated on the site and calculated prior to placing the order.
4. Order and Validation
4.1. Any order implies acceptance of these General Conditions of Sale.
4.2. The customer places his order on the website LeSecret-skincare.com. To purchase one or more products, he must follow the online ordering process which includes a questionnaire phase for the customization of the product.
4.3. Confirmation of the order implies acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
4.4. All data provided and the recorded confirmation will constitute proof of the transaction.
5. Payment
5.1. Validating the order implies for the customer the obligation to pay the price indicated.
5.2. Payment for purchases is made by credit card or any other means offered on the site at the time of ordering.
5.3. The card is debited at the time of the order.
6. Delivery
6.1. Deliveries are made to the address indicated in the order form.
6.2. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.
6.3. EcomSulting LLC declines all responsibility in the event of excessive delivery delays due to postal services or carriers, as well as in the event of loss of ordered products or strikes.
7. Withdrawal and Reimbursement
7.1. In accordance with the legal provisions in force, the customer has a period of 14 days from receipt of the product to exercise his right of withdrawal from EcomSulting LLC, without having to provide reasons or pay a penalty. This provision does not apply to products made to order and personalized.
7.2. In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased and the shipping costs will be refunded; the return costs remain the responsibility of the customer.
7.3. Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.).
7.4. Due to the personalized nature of the products, EcomSulting LLC reserves the right to refuse the return if the product has been opened or used.
8. Guarantees
8.1. All products supplied by EcomSulting LLC benefit from the legal guarantee provided.
8.2. In the event of non-conformity of a product sold, it may be returned to EcomSulting LLC which will take it back, exchange it or refund it.
8.3. All complaints, requests for exchange or refund must be made by email: contact@lesecret-skincare.com within 30 days of delivery.
9. Liability
9.1. EcomSulting LLC, in the online sales process, is only bound by an obligation of means; its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.
9.2. EcomSulting LLC shall not be held liable for any damage resulting from improper use of the purchased product.
10. Intellectual property
10.1. All elements of the LeSecret-skincare.com site are and remain the intellectual and exclusive property of EcomSulting LLC.
10.2. No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.
11. Personal data
11.1. In accordance with the law relating to information technology, files and freedoms of January 6, 1978, personal information relating to buyers may be subject to automated processing.
11.2. EcomSulting LLC reserves the right to collect information about buyers including by using cookies, and, if it wishes, to transmit the collected information to business partners.
11.3. Buyers may object to the disclosure of their contact details by notifying EcomSulting LLC. Similarly, users have the right to access and rectify data concerning them, in accordance with the law of January 6, 1978.
12. Archiving - Proof
12.1. EcomSulting LLC will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy.
12.2. The computerized records of EcomSulting LLC will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
13. Dispute Resolution
13.1. These online sales conditions are subject to the law of the State of Wyoming.
13.2. In the event of a dispute, jurisdiction shall be granted to the competent courts of Sheridan USA, notwithstanding multiple defendants or third-party claims.
